CONSUMER
CONSENT TO THE USE OF ELECTRONIC TRANSACTIONS AND
ELECTRONIC DELIVERY OF RECORDS ("Agreement")
This
Agreement contains important information that you are entitled to receive
before you agree to transact business with us electronically and consent to
receive electronic records from us.
Please
read this Agreement carefully, and download, print and/or save a copy for your
files.
For purposes of this Agreement: "we," "us,"
"our," or "the company" refers to Metropolitan Life
Insurance Company ("MetLife®"), and the affiliates listed below,
jointly and severally, as well as to other of their respective affiliates,
unless otherwise indicated by specific reference to a particular company.
"You" and "yours" refers to the owner(s) of one or more
policies, contracts, and/or accounts issued or offered by any one of us.
MetLife provides the electronic services as described in this
Agreement as a convenience to you. MetLife also provides administrative
services to certain of its affiliates, which include providing materials,
information, and services to you. These affiliates include, but are not limited
to, First MetLife Investors Insurance Company; General American Life Insurance
Company; MetLife, Inc.; MetLife Insurance Company of Connecticut; MetLife
Investors Distribution Company; MetLife Investors Group, Inc.; MetLife
Investors Insurance Company; MetLife Investors USA Insurance Company; MetLife
Securities, Inc.; Metropolitan Property and Casualty Insurance Company;
Metropolitan Tower Life Insurance Company; New England Life Insurance Company;
and New England Securities Corporation.
Please read the following terms and conditions carefully before
providing (a) your agreement to them, and (b) your consent to receiving
electronic records as described below. You may review these terms and
conditions on this web site and any other web site that we make available to
you ("MetLife web site") for delivery of any of the services
described in this Agreement, as they may change at any time at our sole
discretion.
1. Your agreement
and consent.
To the extent permitted by law, this Agreement is a global
agreement and consent, meaning it applies to all types of electronic
transactions that you may enter into and records that may be provided,
delivered or otherwise made available to you during the course of your
relationship with us. When you agree to the terms of this Agreement by clicking
"I Agree" below, you: (a) agree to undertake electronic transactions
and use electronic signatures on a MetLife web site, such as may be needed for
on-line enrollment or policy application, fund transfers, beneficiary
designations, and similar functions, and (b) consent to receive by electronic
means various notices (including, without limitation, annual privacy notices),
disclosure documents and communications from us relating to policies,
contracts, and/or accounts you own and other materials regarding our products,
to the extent available (which may include, but not be limited to, statements,
bills, confirmation statements, prospectuses, prospectus supplements, other
disclosure documents, contracts, explanations of benefits and other materials
that we are, or may be, legally required to deliver to you). You specifically
(i) acknowledge, as part of your acceptance of the terms of this Agreement by
clicking "I Agree" below, that certain of the documents to be
delivered electronically will contain information regarding your personal
financial matters ("Personal Financial Information") and (ii) consent
to the delivery of such Personal Financial Information by the electronic means
specified in this Agreement. The consent that you grant in this Agreement shall
remain in effect until withdrawn by you.
As permitted by the consent you are providing to us in this
document, we will replace paper delivery of any particular document with
electronic delivery at our sole discretion as electronic delivery of particular
documents becomes available. Please make a note to look for documents delivered
electronically. As noted below, we will either send an email to you with the
document attached, or email you a notice that the document has been posted to
our website. Accordingly, if your email address changes, please remember to
provide us with your new email address. Until electronic delivery is initiated
for a particular type of document (including those referenced above), you will
continue to receive such documents in paper form. We will deliver these paper
documents by U.S. mail to the current address we have on file for you.
By agreeing to the terms of this Agreement, you are consenting
to delivery of documents to you in one or more of the following ways:
1.
We may post such document to a MetLife web site. When we post
the document, we will send you an email advising you that we have made such
posting;
2.
We may send you e-mails transmitting such documents, whether as
text in, attachments to, and/or hyperlinks from, such e-mails to the documents
stored at a MetLife web site or otherwise. Such e-mails will be sent to the
current e-mail address we have on file for you. In addition, you may be
notified about the availability of electronic records by text message (SMS -
Short Messaging Service), voice telephone calls (from in-person or automated
systems), or facsimiles. You acknowledge and agree that any charges associated
with your receipt of these messages are fully your obligation and are not
reimbursable by MetLife or any of its affiliates. There may be other third
party costs for eDelivery or a MetLife web site, such as Internet access fees
or text message (SMS) charges. You are responsible for ensuring that neither
your software nor your Internet service provider inhibits or interferes with
the notices and communications described herein; or
3.
We may send you documents by facsimile.
Upon receipt of an e-mail, you will be able to view the document (if in the text of an e-mail). If the
document is in an attachment or accessible via a hyperlink, you must open the attachment or click on
the hyperlink in order to access the document. In either instance, you will need Adobe Reader in order
to access the PDF file. If you do not have Adobe Reader on your computer, you may download it for free
at Adobe.com.
Of course, if a law requires us to provide, send, or deliver
information in writing to you by a specified manner, such as by U.S. mail, we
will continue to do so.
The electronic transactions on a MetLife web site and the use of
electronic records for consumer information may involve us and/or your
employer.
2. Withdrawal of
Consent; updating email address
You may withdraw your consent at any time by clicking on the
unsubscribe link within your MetLife eDelivery emails
or logging-in to online.metlife.com, selecting “My Profile” and then “Change
User Agreement”. To update your email
address please re-register on this site.
3. Effect of not
consenting or withdrawing consent.
You have the right to have records provided on paper. If you
choose either not to consent or to withdraw your consent to the terms of this
Agreement, you will not be able to conduct transactions on a MetLife web site
and receive electronic communications from us. We will resume or continue (as
the case may be) mailing to you paper copies of documents, if we receive notice
that your consent has been withdrawn, that no consent is given, that your email
and text (SMS) messages have been returned as undeliverable, or if we otherwise
deem your consent to have been withdrawn or not given.
4. How to obtain
paper copies; fees.
You may obtain paper copies by printing the record at your
printer or by contacting our Customer Service Department at the number located
on your most recent statement. Although there may be a nominal fee charged for the order of
non-policy/contract/account owner notices and communications; there is no fee
to receive any policy/contract/account owner communications.
5. Computing
requirements.
To use the services described in this Agreement, you must have
access to a computer with an Internet connection. If you would like to be able
to save the documents that you receive, the computer should have a hard drive
or other storage device or be connected to a printer. You must also have an
e-mail account to receive communications. In order to receive documents sent by
facsimile, you must have either a phone line and a fax machine or a computer
with an internet connection, an e-mail account and software that allows you to
receive faxes by e-mail.
6.
Acknowledgement of ability to access records electronically.
When you agree to the terms of this Agreement, you also
acknowledge that you have the hardware and software necessary to access the
records that will be delivered to you electronically, including, but not
limited to, the ability to open a PDF file.
